The Arctic Marine Risk Guideline (the “Service”), is a guideline tool assisting you to improve your understanding of best practices and risk assessments relevant for ship traffic and operations in the Arctic. It is not a compliance tool. The Service applies the risk management process as defined in ISO 31000:2018, and contains best practice methods and data sources for conducting regional and area-wide risk assessments for ship traffic and operations in the Arctic. By accessing and using the Service you and the Company you represent hereby confirms your/its agreement to the following:
While EPPR uses reasonable efforts to ensure that the Service, including, but not limited to, any advice, information and/or material, is accurate and up to date, we make no warranties in respect of the Service. The Service is provided "as is" without warranty of any kind, either express, implied or statutory, including, but not limited to, the warranties of merchantability or fitness for a particular purpose. We do not take responsibility for any decisions taken based on the information provided in this Service.
The use of the Service presupposes and does not replace the application of industry knowledge, experience and know-how. It should only be used by competent and experienced organisations and/or companies and does not release the user from exercising professional judgement. You hereby, on behalf of yourself and the company you represent, waive any claims against EPPR, any party in affiliation with the Arctic Council, and any company contributing to the Service, whether in contract or in tort (including negligence).
EPPR expressly disclaims any legal liability for any special, direct, indirect, consequential, incidental or any other loss or damage, whether in contract or in tort (including negligence), including, but not limited to, loss of use, production, revenue and profits, arising from or in connection with the Service or the use or reliance upon the Service.
This notice and any disputes arising out of or related to same shall be governed and construed in accordance with the laws of Norway, without regard to conflicts of law principles, and shall be subject to the exclusive jurisdiction of the courts located in Oslo, Norway.
By using the service and information accessing the Service, you confirm that you agree to the terms of this important notice and disclaimer. You further confirm that you are authorized to sign for and enter into binding agreements for the corporation, partnership, limited liability company or other entity (“Company”) which you are representing, who agrees to be bound by this agreement, and that you do not act in capacity of a physical person acting as consumer under applicable consumer law.
